Por tanto, este trabajo tiene como objetivo mostrar un ejemplo para estudiantes de la carrera de Derecho de estudio comparado y análisis crítico de la situación actual de la prueba de ADN en el ordenamiento jurídico, de forma comparativa con otras legislaciones, y con especial énfasis en la regulación de la toma de muestras mediante la coacción o por medios subrepticios. Desarrollado el ejercicio crítico se concluye que este tipo de práctica permite identificar los elementos fundamentales en cuanto a doctrina, disposiciones jurídicas, marco legal y vulneración de derechos, además de formarse un juicio crítico de la legislación. El análisis presentado considera como referentes las legislaciones de otros países del área geográfica y de Europa, pudiendo emitirse un juicio crítico en relación a las regulaciones sobre toma de muestras con fines de investigación criminal con respecto la práctica vigente en Ecuador. Finalmente se sugieren posibles reformas legales que buscan solucionar la problemática provocada por vacíos en el ordenamiento jurídico de esta materia.Palabras clave:Legislación, derecho comparado, análisis crítico, criminalística, carrera de Derecho ABSTRACTThe law degree in Ecuador does not delve into the criminology branch, hence the need to provide students with knowledge of the regulatory framework associated with the use of criminalistic techniques’. Therefore, this work aims to show an example for law students of comparative study and critical analysis of the current situation of the DNA test in the legal system in a comparative way with other legislations and with special emphasis on the regulation of taking of samples by coercion or by means of overweight. Once the critical exercise has been developed, it is concluded that this type of practice allows the identification of the fundamental elements in terms of doctrine, legal provision, legal framework and violating of rights, in addition to forming a critical judgment of the legislation. The analysis presented considers the legislations of the other countries in the geographical area and Europe as a reference, being able to issue a critical judgment in relation of the regulations of the subject, demonstrates for criminal investigation purposes with respect to the current practice in Ecuador. Finally, possible legal reforms were uploaded that seek to solve the problem caused by gaps in the legal system of this matter.Keywords:Legislation, comparative law, critical analysis, criminology, law career ER -
