Interés superior de los niños, niñas y adolescentes en Ecuador

Abstract

La protección de los derechos de los niños y niñas debe representar un interés superior para los estados. Contradictoriamente al gran número de disposiciones legales, acuerdos internacionales, políticas públicas nacionales, que se han implementado para garantizar la protección integral de los derechos de las niñas y los niños, actualmente persiste un elevado número de factores que atentan contra su desarrollo integral. La presente investigación realiza un estudio con el objetivo de identificar, prevenir y corregir estos elementos de diversa índole, que violentan los derechos básicos de los menores de edad. Como resultado se aplicó una encuesta que permitió identificar el estado actual de las garantías estipuladas a la protección integral del interés superior de los niños, niñas y adolescentes.

ABSTRACT

The protection of children's rights must represent a superior interest for the states. Contradictorily to the large number of legal provisions, international agreements, and national public policies that have been implemented to guarantee the comprehensive protection of the rights of girls and boys, there are currently a high number of factors that threaten their integral development. This research carries out a study with the aim of identifying, preventing and correcting these elements of various kinds, which violate the basic rights of minors. As a result, a survey was applied that made it possible to identify the current status of the guarantees stipulated for the comprehensive protection of the best interests of children and adolescents.
