La historia del derecho desde la estructura de las revoluciones científicas en el aula universitaria

Resumen

La Historia del Derecho es una rama de la Historia en general. El objetivo del trabajo fue conocer si en el contenido del sílabo fundamentos históricos, filosóficos y epistemológicos del Derecho se incorpora los aportes de la evolución de la ciencia y del Derecho, propuestos por T. Kuhn y Mariana Isern, permitiendo un acercamiento a la teoría existente y lo que se enseña en el aula universitaria. Los métodos utilizados fueron el hermenéutico, interpretativo, gramatical, lógico, histórico. Los hallazgos reflejan las etapas que atraviesan la ciencia y el Derecho, las épocas de evolución de la sociedad, las civilizaciones y sus instituciones jurídicas. Concluyendo que en sílabo mencionado se abordan algunos temas de la época antigua, dejando fuera aportes de la época medieval, moderna y contemporánea..

ABSTRACT

History of Law is a branch of History in general. The objective of the work was to know if the content of the syllabus on historical, philosophical and epistemological foundations of Law incorporates the contributions of the evolution of science and Law, proposed by T. Kuhn and Mariana Isern, allowing an approach to the existing theory and what is taught in the university classroom. The methods used were hermeneutic, interpretative, grammatical, logical, historical. The findings reflect the stages that science and law go through, the periods of evolution of society, civilizations and their legal institutions. Concluding that in the mentioned syllabus some topics of the ancient times are approached, leaving out contributions of the medieval, modern and contemporary times.
