La filosofía del derecho en el aula universitaria

Resumen

La Filosofía del Derecho rama de la Filosofía general que contextualiza el pensamiento jurídico dominante. El objetivo del trabajo es conocer los contendidos de Filosofía del Derecho que incorpora del sílabo fundamentos históricos, filosóficos y epistemológicos del Derecho para la enseñanza de esta disciplina. Para lo cual se identificó los aportes de la Filosofía del Derecho y su aplicación en el aula universitaria. Revisada la bibliografía se coteja las mismas lo que permitió un acercamiento entre la teoría y la práctica. Los métodos utilizados fueron el hermenéutico, el interpretativo, gramatical, lógico, histórico. Los hallazgos reflejan que los aportes significativos de la Filosofía del Derecho que no contemplan el sílabo. Concluyendo que el sílabo el mencionado debe ser modificado.

ABSTRACT

Philosophy of Law is a branch of general philosophy that contextualizes the dominant legal thought. The objective of the work is to know the contents of Philosophy of Law that incorporates from the syllabus historical, philosophical and epistemological foundations of Law for the teaching of this discipline. For this purpose, the contributions of the Philosophy of Law and its application in the university classroom were identified. After reviewing the bibliography, the same was compared, which allowed a rapprochement between theory and practice. The methods used were hermeneutic, interpretative, grammatical, logical and historical. The findings reflect that the significant contributions of the Philosophy of Law that do not contemplate the syllabus. Concluding that the aforementioned syllabus should be modified.
