Responsabilidad médica por mala praxis, análisis en la e Educación de Médicos y Abogados del Ecuador

Abstract

En el ordenamiento jurídico ecuatoriano, la mala práctica médica acarrea la responsabilidad civil, penal y administrativa del médico que incurre en ella. El objetivo de la presente investigación fue determinar el alcance de la misma, con la finalidad de determinar si efectivamente las normas actuales permiten garantizar una reparación integral a las víctimas de mala práctica médica y sus familiares. Para ello fue empleado el método cualitativo, se realizó una recopilación, revisión, análisis, lectura sistemática e interpretación de la información obtenida de fuentes normativas y doctrinarias. Los resultados de la presente investigación reflejan que la normativa actual permite que se garantice la reparación integral de las víctimas cuando se trata de daño material; sin embargo, es insuficiente con respecto al daño inmaterial.

 ABSTRACT

In the Ecuadorian legal system, medical malpractice entails civil, criminal and administrative liability for the physician who commits it. The objective of this research was to determine the scope of the same, with the purpose of determining if the current norms effectively allow guaranteeing a comprehensive reparation to the victims of medical malpractice and their families. For this purpose, the qualitative method was used, and a compilation, review, analysis, systematic reading and interpretation of the information obtained from normative and doctrinal sources was carried out. The results of this research show that the current regulations guarantee full reparation for the victims when it comes to material damage; however, it is insufficient with respect to non-material damage.
