La producción científica en el campo jurídico

Resumen

El presente trabajo presenta los hallazgos de una investigación acerca de las características de los textos científicos que se construyen en un campo específico como el jurídico. Se trata entonces del análisis de artículos publicados en revistas científicas. El material se conformó por artículos de revistas científicas especializadas en Derecho que publican en lengua española. Algunas son indizadas con factor de impacto en Scopus. Se utilizó el método hermenéutico para el análisis de los artículos generando un análisis de acuerdo a una clasificación previa del tipo de citas, así como de los tipos de fuentes a los que recurren estos artículos. Entre los principales hallazgos se puede deducir que hay una tendencia a transcribir literalmente lo que en otra fuente se dice y luego se hace una interpretación.

Con base en el fundamento y análisis a la teoría de la Economía de las Prácticas Sociales de Pierre Bourdieu se puede concluir que el campo jurídico no privilegia o tiene considerado dentro su capital cultural al capital científico o académico, privilegiando otras actividades en esta disciplina.

ABSTRACT

This work presents the findings of an investigation about the characteristics of scientific texts that are built in a specific field such as law. It is then an analysis of articles published in scientific journals. The material was made up of articles from scientific magazines specialized in Law published in the Spanish language. Some are indexed with an impact factor in Scopus. The hermeneutic method was used to analyze the articles, generating an analysis according to a previous classification of the type of citations, as well as the types of sources that these articles resort to. Among the main findings it can be deduced that there is a tendency to literally transcribe what is said in another source and then make an interpretation. Based on the foundation and analysis of Pierre Bourdieu's theory of the Economics of Social Practices, it can be concluded that the legal field does not privilege or consider scientific or academic capital within its cultural capital, privileging other activities in this discipline.
