Justicia Indígena y la Constitución en la formación profesional de Derecho de Ecuador

Abstract

En Ecuador los pueblos y nacionalidades indígenas lograron se reconozca e incorporen sus derechos en la Constitución del 2008, dada la organización y perseverancia de estos pueblos autónomos. A pasar de este proceso, los análisis realizados muestran la existencia de contradicciones entre la aplicación de la justicia normada en la Constitución y la justicia indígena. Se aplicaron varios métodos para el estudio y obtener información sobre la temática, que incluye la valoración de la formación de los profesionales del derecho y sus conocimientos en este sentido. Los resultados muestran la necesidad de realizar cambios en la formación de los estudiantes, el logro de una mayor interacción cultural y la búsqueda de mecanismos de intervención en las comunidades indígenas para el logro de cambios bajo el respeto a su cultura y tradiciones de mayor arraigo.

ABSTRACT

In Ecuador, indigenous peoples and nationalities have been demanding that their rights be recognized, a fact that was achieved in the 2008 Constitution, given the organization and perseverance of these autonomous peoples. Moving on from this process, the analyzes carried out show the existence of contradictions between the application of justice regulated in the Constitution and indigenous justice. Several methods were applied for the study and to obtain information on the subject, which includes the assessment of the training of legal professionals and their knowledge in this regard. The results show the need to make changes in the training of students, the achievement of greater cultural interaction and the search for intervention mechanisms in indigenous communities to achieve changes while respecting their deep-rooted culture and traditions.
