Utilización de métodos pedagógicos actuales para el análisis jurídico de la diversificación de tipos penales

Abstract

Los modelos pedagógicos son construcciones mentales mediante las cuales se reglamenta y normativiza el proceso educativo. Con estas construcciones mentales los docentes definirán: qué se debe enseñar, a quiénes, con qué procedimientos, a qué horas, según cuál reglamento disciplinario, a los efectos de moldear ciertas cualidades y virtudes en los estudiantes. Esta investigación busca acoplar los nuevos y actuales métodos pedagógicos a la enseñanza del Derecho. Particularmente ante el análisis jurídico de la diversificación de tipos penales en el Código Orgánico Integral Penal. Pues resulta compleja la variedad de tipos penales, ya que prácticamente se han creado tipos penales para casi cada hecho jurídico que se produce. Como métodos e instrumentos se utilizaron la revisión bibliográfica y la metodología cualitativa del tipo analítico jurídico. La investigación permitió identificar que los métodos educativos son fundamentales en el análisis jurídico de los tipos penales, ya que permiten a los estudiantes de derecho adquirir las habilidades necesarias para interpretar la ley y aplicarla de manera efectiva.

 ABSTRACT

Pedagogical models are mental constructions through which the educational process is regulated and standardized. With these mental constructions, teachers will define: what should be taught, to whom, with what procedures, at what times, according to what disciplinary regulation, in order to shape certain qualities and virtues in students. This research seeks to couple the new and current pedagogical methods to the teaching of Law. Particularly before the legal analysis of the diversification of criminal types in the Comprehensive Organic Criminal Code. Well, the variety of criminal offenses is complex, since practically criminal offenses have been created for almost every legal act that occurs. As methods and instruments, the bibliographic review and the qualitative methodology of the legal analytical type were used. The research allowed us to identify that educational methods are essential in the legal analysis of criminal offenses, since they allow law students to acquire the necessary skills to interpret the law and apply it effectively.
