El proyecto integrador de carrera como mecanismo de control ambiental en Babahoyo

Resumen

El constante desarrollo del conocimiento jurídico ha permitido ampliar las especialidades del derecho generando materias altamente especializadas y con un amplio impacto social, en ese contexto, en el octavo semestre de la carrera de derecho de La Universidad Regional Autónoma de Los Andes “UNIANDES” con sede en Babahoyo. En el año 2021 se planteó investigar sobre las acciones que el Gobierno Autónomo Descentralizado del cantón Babahoyo estaba realizando para cumplir con los deberes ambientales que le competen acorde a diversas leyes, siendo trascendental documentar el resultado de esta experiencia académica para validar en la realidad si se cumple con el adecuado acceso a la información tal como establecen los tratados internacionales, la Constitución y la ley. Es de esta manera que se propone como objetivo general diagnosticar el cumplimiento de la obligación jurídica de garantizar el acceso a la información ambiental por parte del Gobierno Autónomo Cantonal de Babahoyo, siendo los específicos: caracterizar el marco jurídico internacional y las normas nacionales que se relacionen con este tema, y la presentación de los resultados de la actividad didáctica que realizaron los estudiantes de UNIANDES-Babahoyo. Se obtuvo como resultado la existencia de un incumplimiento de lo legislado, por lo que se procedió a realizar un análisis de las posibles causas que dan lugar al incumplimiento mediante un mapa cognitivo difuso. Con lo cual se podrán establecer acciones futuras en función de mitigar esta situación.

ABSTRACT

The constant development of legal knowledge has made it possible to expand the specialties of law, generating highly specialized subjects with a wide social impact, in this context, in the eighth semester of law school at the Autonomous Regional University of Los Andes "UNIANDES" with headquarters in Babahoyo. In the year 2021, it was proposed to investigate the actions that the Decentralized Autonomous Government of the Babahoyo canton was carrying out to comply with the environmental duties that correspond to it according to various laws, being transcendental to document the result of this academic experience to validate in reality if complies with adequate access to information as established by international treaties, the Constitution and the law. It is in this way that it is proposed as a general objective to diagnose compliance with the legal obligation to guarantee access to environmental information by the Autonomous Cantonal Government of Babahoyo, being the specific ones: to characterize the international legal framework and the national regulations that are related with this theme, and the presentation of the results of the didactic activity carried out by the students of UNIANDES-Babahoyo. The result was the existence of a non-compliance with the legislation, so an analysis of the possible causes that give rise to non-compliance was carried out using a fuzzy cognitive map. With which future actions can be established in order to mitigate this situation.
