Epistemología jurídica desde la perspectiva del constructivismo jurídico complejo de Enrique Cáceres.

Abstract

El Derecho es una realidad compleja conformada por distintas naturalezas (normativa, sociológica, valorativa entre otras) que le son relevantes en su construcción ontológica. El científico del Derecho debe preguntarse sobre el conocer por lo menos en dos planos. En el plano de la racionalidad de las categorías, conceptos y modelos paradigmáticos y científicos que constituyen el quehacer de la ciencia jurídica y, por el otro, la realidad normativa, institucional, social, en que se desarrolla la vida humana. En este sentido podemos hablar de una epistemología teórica y una epistemología aplicada. Esta investigación, bajo la modalidad cualitativa y, mediante el empleo de los métodos filosófico y hermenéutico, logró profundizar en el análisis de la Epistemología Jurídica en el contexto de la Filosofía del Derecho, partiendo del “Constructivismo Jurídico Complejo” de Enrique Cáceres, en el marco de la Epistemología Aplicada.

ABSTRACT

Law is a complex reality made up of different natures (normative, sociological, evaluative, among others) that are relevant to its ontological construction. The legal scientist must ask himself about knowing at least on two levels. At the level of the rationality of the paradigmatic and scientific categories, concepts and models that constitute the work of legal science and, on the other, the normative, institutional, social reality in which human life develops. In this sense we can speak of a theoretical epistemology and an applied epistemology. This research, under the qualitative modality and, through the use of philosophical and hermeneutical methods, managed to deepen the analysis of Legal Epistemology in the context of the Philosophy of Law, starting from the "Complex Legal Constructivism" of Enrique Cáceres, in the framework of Applied Epistemology.
