Propuesta pedagógica para la enseñanza del derecho a la defensa en el procedimiento directo relativo al tránsito

Abstract

La vulneración de derechos, del procesado sometido al procedimiento directo se contrapone a los derechos y garantías constitucionales. El objetivo fue conocer la percepción de los juristas, en su conocimiento del Estado de derecho en materia de tránsito, para recomendar una propuesta pedagógica que aborde en la carrera de Derecho, la formación con respecto a la vulneración del Derecho a la defensa en aplicación del procedimiento directo en materia de tránsito en Santo Domingo. Se utilizó el método mixto, partiendo de una investigación descriptiva, explicativa y de campo, con un enfoque cualitativo, con el método histórico, realizando una indagación bibliográfica, doctrinal y jurisprudencial. Se pudo evidenciar la falta a los principios de contradicción, inmediación, publicidad y celeridad procesal, por falta del tiempo adecuado que garantice el derecho a la defensa y validar el debido proceso.

ABSTRACT

The violation of rights, of the defendant submitted to the direct procedure contrasts rights and constitutional guaranties itself. The objective was to know the perception of the jurists in its knowledge, of the State by right on the subject of transit, in order to recommend a pedagogic proposal that you go on board in the running by right, the formation with in relation to the violation of the right to the defense in application of the direct procedure on the subject of transit in St. Domingo. You utilized the mixed method, departing of a descriptive research, explanatory and of field, with a qualitative focus, with the historic method, accomplishing a bibliographic, doctrinal and investigation based on previous court resolutions. The lack could become evident in the beginning of contradiction, immediacy, publicity and procedural celerity, for lack of the appositeness that you guarantee the right to the defense and validating the proper process.
