Necesidad de actualización docente y legislativo sobre el patrimonio familiar como figura jurídica.

Resumen

La necesidad de actualización de los docentes que imparten carreras jurídicas es fundamental para garantizar una educación de calidad en esta área. El derecho es una disciplina en constante evolución, y los cambios en la legislación y la jurisprudencia pueden tener un impacto significativo en la práctica jurídica. La institución jurídica del patrimonio familiar, constituida para asegurar el bienestar social de la familia, no está cumpliendo con su papel, toda vez que con el pasar de los años las circunstancias que la originaron han mutado. El objetivo de esta investigación es realizar un análisis de la normativa en cuanto a esta figura jurídica, y determinar hasta qué punto, la educación en la carrera de Derecho está siendo efectiva respecto a la figura del patrimonio familiar. La metodología de investigación utilizada fue de modalidad cuali-cuantitativa, llevando implícita la investigación jurídica de carácter documental con interpretación hermenéutica de la bibliografía consultada.  Como resultado del análisis jurídico, se determina que resulta necesaria una actualización tanto a nivel legislativo, como docente en cuanto al tema de estudio, pues en la actualidad existen circunstancias distintas a las que se determinaron durante la conformación de la ley, que resultan contrarias a la protección que se pretende.

ABSTRACT

The need to update teachers who teach legal careers is essential to ensure quality education in this area. Law is a constantly evolving discipline, and changes in legislation and case law can have a significant impact on legal practice. The legal institution of family patrimony, constituted to ensure the social welfare of the family, is not fulfilling its role, since over the years the circumstances that originated it have mutated. The objective of this research is to carry out an analysis of the regulations regarding this legal figure, and determine to what extent, education in the Law career is being effective with respect to the figure of family patrimony. The research methodology used was qualitative-quantitative, implicitly involving legal research of a documentary nature with hermeneutic interpretation of the consulted bibliography. As a result of the legal analysis, it is determined that an update is necessary both at the legislative and teaching level regarding the subject of study, since there are currently circumstances different from those that were determined during the creation of the law, which are contrary to the protection sought.
