Beyond Positivism and Natural Law: An Educative Integrative Approach

This research addresses the "third way" in Legal Theory, also known as "Non-Positivism." The critique of the dichotomy between Positivism and Natural Law lies in the fact that both approaches tend to simplify the complexity of the legal phenomenon. Therefore, a balance of the elements inherent in the aforementioned legal currents is conducted. The objective of this research was to demonstrate the importance of the "third way" in legal processes to the law students at the Regional Autonomous University of the Andes (Uniandes). The research adopted a qualitative approach, involving document analysis that verified the significance of both legal norms and ethical and moral principles in the interpretation and application of law. Educational actions were proposed to help the law students at Uniandes recognize the importance of the "third way," as it not only provides theoretical tools to address contemporary legal challenges but also promotes a more comprehensive and just perspective of the law.
