La investigación jurídica: objeto, paradigma, método, alcance y tipos

Abstract

La investigación jurídica, rama de la indagación científica, disciplina que pertenece a la Filosofía de la Ciencia, que aborda las reglas generales de la ciencia en general y del Derecho en particular, organiza criterios usados por el investigador. La pregunta guía fue ¿en los proyectos de investigación de pregrado de la carrera de Derecho la investigación dominante es la científica o jurídica? El objetivo fue conocer la investigación dominante en el proyecto de investigación, su objeto de estudio, enfoque, métodos, alcance y tipos. Se utilizó el método hermenéutico, interpretativo, gramatical, lógico, histórico. Los hallazgos demuestran que, la investigación dominante es la científica. Concluyendo que existe confusión en la utilización de los componentes mencionados, dejando de lado la investigación jurídica.

ABSTRACT

Legal research, a branch of scientific inquiry, a discipline belonging to the Philosophy of Science, which deals with the general rules of science in general and law in particular, organizes criteria used by the researcher. The guiding question was: in undergraduate research projects of the Law career, is the dominant research the scientific or legal one? The objective was to know the dominant research in the research project, its object of study, approach, methods, scope and types. The hermeneutic, interpretative, grammatical, logical, historical method was used. The findings show that the dominant research is the scientific one. Concluding that there is confusion in the use of the mentioned components, leaving aside the legal research.
