La efectividad en la enseñanza del marco legal entorno al Bienestar Animal

Resumen

Reconocer los animales como sujetos de derecho, es un debate a nivel internacional. Ecuador colocó el tema en su Constitución del 2008, de donde se desprenden normas jurídicas, buscando dar cumplimiento a ello. Una enseñanza efectiva de la legalidad que respalda la protección animal, es indispensable para lograr que esta se haga realidad. Por ello, el objetivo de la investigación es: identificar las limitantes existentes para la enseñanza efectiva del marco legal entorno al bienestar animal en Ecuador. Se emplearon métodos teóricos y empíricos, la prueba de Wilcoxon y el método Vikor. Como resultado se obtuvo que los entrevistados mayoritariamente no perciban solidez del marco legal que sustenta el bienestar animal y no encuentran adecuada la equivalencia de las medidas tomadas, en relación con los hechos cometidos contra los animales. Se identificaron dificultades que limitan la enseñanza efectiva del marco legal entorno al bienestar animal. La prueba de Wilcoxon arrojó que no existen diferencias significativas entre la aplicación de ordenanzas municipales y el maltrato animal. Con la aplicación del método Vikor, se jerarquizó como acción principal, la necesidad de otorgar mayor peso a los mecanismos para la protección animal entre las materias que se imparten en la carrera de derecho.

ABSTRACT

Recognizing animals as subjects of law is an international debate. Ecuador placed the issue in its 2008 Constitution, from which legal norms emerge, seeking to comply with it. An effective teaching of the legality that supports animal protection is essential to make it a reality. Therefore, the objective of the research is: to identify the existing limitations for the effective teaching of the legal framework around animal welfare in Ecuador. Theoretical and empirical methods were used, the Wilcoxon test and the Vikor method. As a result, it was obtained that the majority of the interviewees do not perceive the solidity of the legal framework that supports animal welfare and do not find the equivalence of the measures taken adequate, in relation to the acts committed against animals. Difficulties that limit the effective teaching of the legal framework around animal welfare were identified. The Wilcoxon test showed that there are no significant differences between the application of municipal ordinances and animal abuse. With the application of the Vikor method, the need to give greater weight to the mechanisms for animal protection among the subjects taught in the law degree was ranked as the main action.
